FCC Sides With DirecTV's Decision To Deny Carriage To Texas TV Station Johnson Broadcasting Inc., licensee of commercial television station KNWS, Channel 51, in Katy, Texas, lost its request for the Federal Communications Commission CC to force Hughes Electronics [GMH] subsidiary DirecTV Inc. to carry the TV station's signal.
Johnson Broadcasting filed a complaint with the FCC against DirecTV, citing Section 338 of the Communications Act of 1934, and Section 76.66 of the commission's rules, for rejecting the signal of KNWS from inclusion among the local channels that DirecTV provides in Houston, Texas. Houston is the designated market area (DMA) where KNWS operates.
The FCC ruled that DirecTV did not fail to meet its must carry obligations under the commission's satellite broadcast signal carriage rules that require all local channels to be offered in a market where any of them are provided by a satellite TV provider. KNWS lost its bid for carriage for failing to meet a deadline to request inclusion of its signal in the Houston market by DirecTV, the FCC explained.
Broadcast stations were required to notify satellite carriers by last July 1 if they wished to be included among the local signals offered by a satellite TV provider beginning Jan. 1, 2002. A local television station is required to notify a satellite TV provider in writing to identify reasons for claiming that its signal should be carried, according to the FCC. >TK
